Indictment charges that in August 1921 . Those named "did unlawfully combine, conspire and confederate together for the purpose of inflicting punishment and bodily injury upon John C. Gore, Don Chafin, and many other persons. . . Against the peace and dignity of the State." It is further charged that in pursuance of the conspiracy the persons named murdered John C. Gore and that Frank Keeney, Fred Mooney and William Petry did "knowingly counsel, aid, abet," etc., the named persons in committing the said felony.
